1. Acceptance of Terms
By accessing or using UpgradeMatch ("we," "our," or "us"), you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree to these terms, please do not use our services. These terms apply to all visitors, users, and others who access the service.
2. Service Description
UpgradeMatch operates as an online marketplace connecting homeowners with third-party home improvement contractors ("Service Professionals"). We are not a general contractor and do not perform any renovation work. Our role is strictly limited to matching your project details with professionals in our network who may be interested in performing the work.
Important Note: We do not endorse or recommend any specific Service Professional. It is your sole responsibility to evaluate the qualifications, licensing, and insurance of any Service Professional you choose to hire.
3. User Obligations
By using our service, you represent and warrant that:
- You are at least 18 years of age.
- You have the authority to enter into agreements regarding the property in question.
- All information you provide is accurate, current, and complete.
- You are using the service for personal, non-commercial use to find contractors for a legitimate project.
4. Lead Submission & Communication
Consent to Contact
When you submit a project request ("Lead"), you expressly consent to being contacted by UpgradeMatch and up to 4 Service Professionals. You agree that these parties may contact you via phone, email, text (SMS/MMS), or automated dialing technology, even if your number is listed on a Do Not Call registry.
Your consent to be contacted is not a condition of purchase. You may opt-out of communications at any time by following the unsubscribe instructions provided in the messages or by contacting us directly.
5. Contractor Matching Process
Upon submitting your project details, our algorithm identifies potential Service Professionals in your area based on trade, geography, and availability. We do not guarantee that we will be able to match your request with a Service Professional. The number of matches may vary depending on your location and the specific nature of your project.
6. No Guarantee of Service or Pricing
UpgradeMatch makes no guarantees regarding:
- The skills or workmanship of any Service Professional.
- The pricing or quotes provided by Service Professionals.
- The availability of contractors in your specific ZIP code.
Any agreement you enter into with a Service Professional is strictly between you and that professional. UpgradeMatch is not a party to any such agreement and is not responsible for the performance or non-performance of any services.
7. Limitation of Liability
To the fullest extent permitted by law, UpgradeMatch shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses resulting from the use or the inability to use the service or any interactions with Service Professionals.
8. Dispute Resolution
Any dispute arising from or relating to these Terms or your use of the Service shall be resolved through binding arbitration, rather than in court. This means you waive any right to a jury trial or to participate in a class action lawsuit.
If you have a dispute with a Service Professional, you must address such dispute directly with the Service Professional. UpgradeMatch is not responsible for resolving disputes between homeowners and contractors.
9. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the new Terms on this site and updating the "Last Updated" date. Your continued use of the Service following the posting of changes constitutes your acceptance of such changes.
